Any term not defined in this Privacy Policy has the meaning defined or ascribed to it in our Terms of Use.
Epicurean Cutting Surfaces, LLC (“Epicurean”, “we”, “us” or “our”) respects and is committed to protecting your privacy. This Privacy Policy (this “Privacy Policy” or “Policy”) applies to information we collect when you use our Site and when sending us email, text, and other communications. This Policy does not apply to information collected offline or by any third party (including our affiliates and subsidiaries), through any channels, application or content (including advertising) that may link to, be accessible from, or on, the Site.
This Privacy Policy describes our privacy practices, including how we obtain, collect, store and use information obtained from users of the Site. This Privacy Policy also describes your rights, as well as the choices available to you regarding our use of your information. Even if you are just browsing (visiting) our Site and don’t order or purchase anything and don’t provide us with information, we may still obtain information the law considers “personal information” (defined below) when you use our Site. In addition to purchasing products, our Site also allows you to contact our customer service representatives for assistance, as well as our sales department to inquire about the products and services we offer. If you use either of those features to send us a message, you may be sending us personal information (e.g., your email address) and we have the right to use the personal information you send us to respond to you, in addition to any other rights described in this Privacy Policy.
In this Privacy Policy, we use the term “personal information” to mean and refer to any data or information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person or household or that could uniquely identify a person. Laws and regulations of some jurisdictions define personal information or personally identifiable information very broadly and may even include things such as IP protocols, browser and mobile device data, so if there is any possibility we may be able to determine an individual’s identity using our Site, even if we have no intention of trying to identify anyone, it may be covered by the law. Consequently, for purposes of this Privacy Policy we include all such information within the meaning of the term “personal information.” “Personal information” does not include information that is de-identified or aggregated in a way that no individual can be readily identified.
We may also use third party operational service providers, e-commerce platforms, website and communications support resources and other professionals in the hosting, operation, maintenance and support of our Site (“Service Providers”). If and when we use Service Providers, we will have agreements with each of them that obligate them to the same requirements regarding your personal information that apply to us under this Privacy Policy.

2. How We Collect Information and What Kinds of Information We Collect
The information we collect from you depends on how you use our Site and how you interact with us. We will only collect personal information that is reasonably necessary for the purpose of providing our services to you. We may collect different kinds of personal information about you: (i) when you use our Site; (ii) from automated data collection technologies; and (iii) when you contact us or request information, as further described below.
When You Use Our Site: When you use our Site, our Site may automatically collect and store non-personal elements of information related to your use. Generally, all this non-personally identifiable information is recorded in such a way that it does not reflect or reference any identifiable individual. However, even though this information does not identify you, as mentioned above, some privacy laws may include this information within the definition of “personal information”, and we consequently treat such information as personal information to comply with such laws. For example, non-personally identifiable information may include the type of Internet browser and operating system you are using, your IP address, the domain of the website you came from (sometimes called a “referring URL”), how many times and the dates and times of your visits and the average amount of time you spend on our Site. Sometimes our Site may also be able to identify the application or device you are using, your mobile network (e.g., carrier name and phone number) and the interaction of your apps, browser and devices with our Site. Technology may enable us to determine when you search on our Site for particular words and the content your browser opens. We may keep track of pages you visit, content your browser displays, as well as third party advertisements and content and even the hypertext links you select on our Site. Gathering this information can help us better understand how to improve our Site and the user experience when you visit. Sometimes, with varying degrees of accuracy, your location can be determined by your IP address, GPS, sensor data from your device or from nearby technology (e.g., Wi-Fi access points; cell towers; Bluetooth-enabled devices) and the capability to capture this type of information often depends on your device location settings, which you generally have the ability to turn on or off.
Automated Data Collection Technologies: Our Site may also use technology to remember whether you’ve been there before. A “cookie” (i.e., a text file placed on your hard disk by a web page server) is one example, but there are currently many different types of technology that perform similar functions (e.g., pixel tags, server logs, invisible GIFs, web beacons, application data caches). Some of the technology our Site uses makes things more efficient and may provide faster loading times for content that benefits users who visit our Site repeatedly. Similarly, unique, non-personal identifiers (“tags”) enable us to track information without identifying you or any individual. Tags may simply be strings of characters that can uniquely identify a browser, app, or device. You may be familiar with an IMEI number associated with your mobile device - a unique identifier incorporated into the device by the manufacturer. Most browsers and some devices give you the ability to configure your settings to refuse cookies or indicate when a cookie is being sent or prevent certain data gathering or tracking technologies. While you should configure those settings in any way you prefer, some features, functions and content on our Site may not function or be displayed fully or properly based on your choice of settings.
When You Contact Us or Request Information: When you enter your name, email address and other contact information to ask us for information and/or when you enter your shipping address and payment information to place an order, you understand, are acknowledging and agree that by doing so, you are giving us explicit consent to allow us to use your personal information and your permission to respond and/or to process your orders.

3. How We Use Information Collected About You
We only use the information we collect for purposes which are permitted by law, including:
- To maintain and improve the performance and operation of our Site and obtain analytical data and metrics so we can better understand how our Site is being used and improve your experience when using our Site;
- To help operate, administer and improve the quality and performance of our Site, track outages or troubleshoot problems and to detect, prevent and respond to possible fraud, abuse and security risks;
- To fulfill your orders, to respond to your requests and/or contact you if you are a Registered User or otherwise as permitted by law;
- To respond to your inquiries if you contact us and help resolve any issues you may be having;
- To personalize or customize your experience while using our Site, including your participation in our promotions, contests and other features and functions we make available to Registered Users and sometimes certain sample promotions, contests or other features we may make available to non-registered users;
- To allow us to deliver and improve Content we believe may be of interest to users of our Site;
- To protect us and others from harm and to detect, respond and help us prevent fraud, abuse, and security risks (e.g., SPAM, malware or malicious code) that could do harm;
- To comply with legal or regulatory requirements and to respond to requests from courts or other government bodies;
- To process your information for any of our other legitimate interests not described above.
We may, in conjunction with our Service Providers, use your information to deliver targeted advertising to you when you visit our Site. In addition, because many of these technologies ‘remember’ the websites you have visited and the searches you have made using your browser, even when you visit other third party websites, the technology may allow and enable targeted advertising to appear that is related to your browsing and searching history. This is often referred to as “behavioral advertising” and is used to customize and deliver advertising we believe is more tailored to your personal interests and preferences. Again, you can configure the settings in your browser and the devices you use, to block certain technologies from doing so and you should consult the manufacturer’s or browser provider’s instructions that explain how to change your settings, but you must do this on each device and browser you use to be effective.
We do not share, sell, rent, or lease your personal information obtained through our Site to anyone, including third parties for marketing purposes or to mass marketers, unless we have your permission. We may use your personal information for our own purposes to better understand our customers, potential customers, and to improve our own ability to market, promote and improve our products and customer service, as well as to improve our Site. We will always ask for your consent before we use your personal information for a purpose that isn’t covered by or provided for in this Policy.
4. Disclosure of Information Collected About You
We may disclose your information, including your personal information, to our Service Providers, technical and support consultants, independent auditors, and other third parties who make our Site available or enhance its functionality. We may share and provide information to third parties, including information that may have been derived from personal information, for marketing, advertising, research or other uses, including, without limitation, aggregated information regarding activity on our Site for use in the research and development of marketing and promotional strategies, but if we do, we will do so only in aggregated form that does not enable identification of any individual.
We reserve the right to and may disclose personally identifiable information about you in response to (a) requests from local, state, or federal law enforcement officials; (b) any judicial, administrative, or similar proceeding or order, such as a subpoena; (c) if required by law; or (d) to investigate suspected fraud, harassment, physical threats, or other violations of our Agreement, the rights of third parties, any law or regulation, or to investigate suspected conduct we deem improper.
We may also disclose your personal information under the following limited circumstances:
- If we have your consent;
- To fulfill the purposes we collected it for, as well as satisfying any legal, accounting, or reporting requirements;
- If we are required to do so by legal or regulatory requirements;
- If we have a good faith belief that access, use, preservation or disclosure of personal information is reasonably necessary to meet legal, regulatory, judicial or other enforceable government requests (g., court orders, regulatory investigative demands or any legal compulsion (e.g., subpoena) served on us;
- To respond to threats or attacks on the security or integrity of our Site;
- To Service Providers who help us operate and maintain our business and technology, serving visitors and users, so long as those parties agree to keep the information confidential and, at a minimum, comply with all the terms, conditions and requirements of this Privacy Policy;
- To enforce any and all terms and conditions of our Agreement with you applicable to our Site;
- To detect, prevent, or address fraud, security, or other technical issues, including our investigating potential abuse or violations;
- To protect or defend against damage, harm or violations of our rights, property or safety, or the rights, property or safety of others, including, without limitation, the public, as and if required by law; and/or
- If we are involved in a merger, acquisition, or sale of assets, we’ll continue to ensure the confidentiality of your personal information and give affected users notice before transferring any personal information or your becoming subject to a different privacy policy.
5. Marketing Preferences
If you have provided us with your contact information, we may, subject to any applicable anti-spam laws or regulations, contact you via e-mail, postal mail or telephone about our products, services, and/or events that may be of interest to you. If you ask us to respond to you by email, you will always be given the ability to opt out of receiving future emails by using the unsubscribe link at the bottom of each we send you, or by contacting us as set out below in Section 16 (Contact Us). You can also use our “Unsubscribe Form” to opt out of any future promotional and marketing messages. You understand we will always have the right to contact you about orders, purchases and customer service related to any transactions you initiate with us.
Canadian Residents: We will only send you marketing messages if you provide your consent to receive them. You may unsubscribe at any time using any of the methods outlined above. All marketing messages will comply with applicable Canadian anti-spam legislation.
6. Do Not Track Option
“Do Not Track” or “DNT” is a preference you can set in your browser to inform websites you do not want to be tracked. However, not all browsers offer a DNT option and DNT signals are not yet uniform. We use OneTrust on our Site to allow you to manage your consent preferences, and while OneTrust adheres to the standards required to comply with legal and regulatory obligations, neither we nor OneTrust monitors or responds to Do Not Track requests. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.
7. Registered Users and Guest Orders
If you are a frequent visitor or purchaser of our products, we encourage you to set up an account and become a Registered User (defined below), but you are not required to become a Registered User to order from us and you can do so as a ‘guest’ without registering or setting up a profile or account. However, as a ‘guest’, each time you order you will have to re-enter the information necessary to process your order.
As mentioned above, you can use our Site to order products we offer and make available for sale. We give you the ability to become a “Registered User” and enter information into a profile that allows us to set up an account for you and store the information to make it easier for you to make purchases and interact with us. Simply go to the My Account tab on our Site and start the registration process as a new user if you are interested and follow the instructions provided. As a Registered User, you will be able to log in to your account and use the information already in your profile to make ordering products easier in the future. There are additional terms and conditions that apply to Registered Users that relate to your information and security, as well as your ability to order products easily (the “Registered User Agreement”). You will have a chance to read and review the Registered User Agreement during the registration process and any time while you remain a Registered User and we urge you to do so because when you become a Registered User, the Registered User Agreement supplements and forms a part of this Privacy Policy and the Agreement we have with you. When you enter or provide information to us, you are acknowledging and giving us explicit consent to allow us to use your personal information in connection with your profile, your account and your status as a Registered User, including the processing and fulfillment of orders you place and purchases you have made.
8. Processing Your Payments
Whether you are a Registered User or a guest, we use a third-party payment processing provider as our Service Provider to process payments for the products you order. When you place an order, your browser will automatically be re-directed to the Service Provider to process your payment information related to your order. Their terms and conditions, as well as their privacy policies, apply to the payment and transaction processing information you enter when you are making payment for any order you place. Whether you are ordering as a guest or a Registered User, it means you will be providing additional personal information which is subject to this Privacy Policy and, if applicable, the additional terms and conditions in the Registered User Agreement.
9. Storage and Retention of Your Information
We may store personal information on servers and storage media of ours or our Service Providers and we may share personal information in aggregate or anonymous form with third parties for storage purposes and to help gather statistics and Site analytics or to respond to your requests and orders. Our servers follow industry standards and are based in North America. Service Providers with whom we share personal information are prohibited from using personal information and are required to treat and handle personal information, at a minimum, in a manner consistent with this Privacy Policy. By using our Site or otherwise providing us with personal information, you agree to the transferring of your personal information in accordance with this Privacy Policy and applicable data protection laws and regulations.
We retain personal information for only as long as necessary to provide the services and fulfill the transactions you have requested, or for other business purposes, including but not limited to complying with our legal obligations, resolving disputes, and enforcing our agreements. We are required by law to keep some types of information for certain periods of time (e.g., statute of limitations). Personal information that is no longer required will be securely destroyed, erased, or anonymized so that it cannot be identified to you or any other person, in accordance with our guidelines and procedures and applicable laws. We may use aggregated information about our users, and information that does not identify any individual, without restriction.
10. Links to Other Websites and Social Media Platforms
Our Site may contain links to other websites or apps that are not controlled or operated by us. If you click on a link, you will be directed to a third party’s website (URL) and we strongly advise you to review the privacy policy of every website you visit, because their terms of use and privacy policies will apply, not ours. We do not endorse, screen, approve monitor, evaluate, review or have any control over the content, privacy policies or practices of any third-party websites or services and assume no responsibility for them. Visiting any other websites or apps is at your own risk.
Our Site may also contain links to social media platforms, and if you choose to connect to them, depending on the social media platform and your settings, if you post or enter information or interact with the platform or others, your information may also be visible to others. You do so at your own risk and like any other third-party links, we have no control over and are not liable or responsible for any use of your information by or through any social media platforms.
Our Site may contain various videos of the platform YouTube, which is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066. These videos are embedded on our Site with the aid of a plug-in – a program that allows you to view the videos directly through our Site. Although they appear on our Site, your browser is actually establishing a direct connection to YouTube servers and YouTube can detect the websites you have accessed, including our Site. If you have a YouTube account, YouTube may also be able to associate this information with your personal user account with them. You may be able to avoid this if you log out of your YouTube account before viewing the videos (which use these plug-ins), but to be sure, you should consult YouTube’s privacy policy and terms of use. Whether the third-party content appears within our Site environment, or you leave our Site for another website to view it, the terms, conditions, and privacy policies of those other websites govern your online experience.
11. How We Keep Your Information Secure
We establish and maintain reasonable security measures and physical, technical, and organizational safeguards appropriate to the sensitivity of the information and try to keep track of known security threats and prevent problems before they occur. If we cannot prevent them, we try to detect and correct them promptly, in compliance with applicable laws and regulations. As the internet and technology constantly evolves, you should be aware that 100% security is not always possible. Further, since the transmission of information via the Internet is not always secure, we cannot ensure, warrant, or guarantee the security of any such personal information. By accessing our Site, you agree that you are using the Site and transmitting personal information at your own risk.
12. Your US Privacy Rights
We want you to have choices and control over how we collect and use your personal information.
As described in this Privacy Policy, you can always configure your browser and device settings. Review the user guide or instructions from the browser provider or manufacturer of your device, which should have specific details regarding the settings that apply and your ability to configure them to your preferences.
You have the right to ask us to provide you with a digital file containing a copy of your personal information and the right to request that we delete all or any portion of your personal information. You should understand that if you are a Registered User and you exercise this right, it may result in our deleting your profile, your account and status as a Registered User, although we reserve the right to retain any of your personal information as long as necessary to fulfill and service any orders you have placed.
Residents of certain States may have certain privacy rights with regard to personal information. If your information is subject to a privacy law in your State, you may have the right:
- To know what categories of personal information we collect;
- To know the purposes for which we collect and use personal information and to whom personal information is disclose and/or shared;
- To know what specific personal information we have about you and with whom we shared or provided it;

- Repair or correct errors, malfunctions or deficiencies in our products, our Site, our systems or communications capabilities; and/or
- Comply with our legal and regulatory obligations.
If we need to retain information for limited periods for business or legal purposes, including those noted above, we only keep it as long as necessary for us to comply with those requirements. We also need to be sure your personal information is not accidentally or maliciously altered or deleted without your permission or knowledge, so there could be a delay in deleting information in our systems and backups to make sure we are following your instructions.

Bear in mind that only you or someone legally authorized to act on your behalf under the laws of the State where you reside may send us a request to exercise these rights. If you send us an email or a letter, your request must include enough information to enable us to verify you are the individual that is the subject of your request or authenticate any other individual you authorize, and we may request additional information or confirmation from you to do so. You should describe your request, consistent with your rights, in enough detail so that we can understand and respond to it properly, and you should understand it will only cover the 12-month period preceding your verifiable and understandable request. If you do not provide the above information, or if we cannot verify your identity or the authority of another person to make the request on your behalf and make sure the request relates to your information, we will not be able to honor your request until these conditions are met.
We will generally respond to a complete and proper request, at no charge to you, within 45 days of receiving your verifiable and understandable request. If we need more time, we will notify you, but it won’t be longer than another 45 days. If we send you a digital file to allow for data portability, we will use a file format that is widely used and which should allow you to transmit the information from easily.
13. Your Canadian Privacy Rights
This Privacy Policy is designed to comply with applicable privacy legislation in Canada, including the Personal Information Protection and Electronic Documents Act and substantially similar provincial privacy laws.
If you are a Canadian resident, you may request additional information from us about:
- The personal information we hold about you;
- Including the categories of personal information concerned;
- Details to whom your personal information has been disclosed;
- If we did not collect the personal information directly from you, information about the source; and
- How to lodge a complaint with the correct supervisory authority.
You may also request that we delete your personal information in accordance with applicable laws.
There may be circumstances where we are unable to provide access to your personal information. We may deny access for legally permissible reasons, such as situations where the information contains references to other users and is not reasonably severable, or where it cannot be disclosed for legal, security, or commercial proprietary reasons. We will advise you of any reason for denying an access request.
To review or update your personal information in our possession, withdraw consent for the collection, use, and/or disclosure of your personal information or if you do not understand or agree with our practices as described in this Policy, please contact us as set out below in Section 16 (Contact Us). Please note that when requesting access to personal information, we may request confirmation of your identity and other details to protect you and to help us to respond to your request. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
14. We Do Not Knowingly Collect Data from Certain Individuals
Our Site is not intended for children, and we do not knowingly collect personal information from anyone under the age of 18 (a “minor”). If you are a parent or legal guardian and determine or suspect we may have received information from your minor child, or if you believe we might have information from or about a child under 18, please notify us immediately as set out in Section 16 (Contact Us). If we learn that we have collected or received personal information from a minor under 18, without verification of parental consent, we will promptly take steps to delete that information where it may be in our possession or under our control.
Our Site is also not intended for anyone outside the United States or Canada, and the laws and regulations that apply may not be considered adequate if you are a citizen or legal resident of another country. If you still choose to use our Site, you are expressly consenting to and authorizing the export, transmission, storage and use of your information, including personal information, to and in the United States of America and/or Canada, and understand and agree it will be subject to the provisions of this Privacy Policy, as well as the Federal and State/Provincial laws and regulations applicable in the United States of America or Canada, and not the laws of any other jurisdiction.

We regularly review this Privacy Policy and our compliance with it, to make sure we keep up to date with our legal obligations. We may amend, modify and/or update this Privacy Policy from time to time and we will post the new Privacy Policy on this web page. Unless we explicitly provide for a future effective date, the new updated Privacy Policy will be effective when we post it, so check back here often so you remain aware of all of the terms and conditions that apply to you. Your continued use of our Site after we make changes constitutes acceptance of those changes.
